Three MLAs of the Karnataka Legislative Assembly, including Vatal Nagaraj plans to move the High Court requesting its intervention on their petition seeking disqualification of 40 JDS MLAs under the provisions of anti-defection laws.
"In the event of Speaker Krishna not passing orders at the November 17 hearing on our petition, we will move the High Court for relief," Nagaraj said here.
The petition, which they have filed before the Assembly Speaker, has been pending since 18 months, he pointed out.
He said they would file one more application tomorrow before the Speaker, praying for summoning JDS rebel MLA P G R Sindhya as one of the witnesses, along with former home minister M P Prakash.
Krishna has already summoned JDS chief H D Devegowda to appear before him as a witness on November 17 to explain reasons that prompted him to write to the then Governor T N Chaturvedi on January 18 last in not giving credence to the group led by his son H D Kumaraswamy.
